Equal Pay Training

It has been over fifty years since the enactment of the Equal Pay Act. Yet the issue of pay equality has never been more prominent in the news and the legal compliance field. At the forefront are new state laws making it easier than ever for employees and government agencies to bring pay discrimination claims. Employers are struggling with how to handle inquiries about a company’s pay practices and assessments, especially in light of recent investor activism and high-profile companies’ public proclamations about pay equity.

Employers also are struggling with how best to ensure employees responsible for hiring and promotions are considering only criteria that are allowable under applicable laws, and appropriately documenting to meet new burden of proof standards. New and pending state and federal laws prohibiting employers from inquiring about or considering a prospective employee’s salary history have also been of critical concern. This course provides your managers, HR staff, and legal team with a detailed understanding of the new pay equity laws, rules and trends, with special focus modules available for California, Illinois, Massachusetts, New York and other states (given their recently enacted pay equity/equal pay laws). The training emphasizes how these laws impact your pay and record-retention practices, as well as how disparities can be avoided through sound, consistent practices and documentation.

The course further stresses how employers should communicate to employees regarding pay-related decisions. Critically, multiple customized exercises (particularly in the California-specific version) focus on simple skills to consistently, adequately and clearly document all decisions and communications that impact pay rates or other forms of compensation. Such documentation practices may relate to job descriptions, offers to job candidates, salary levels and increases, job evaluations, bonus pay, overtime, performance issues, and other areas.

Additional course modules may include: OFCCP, EO 11246 and other affirmative action requirements concerning pay; the different equal pay analysis undertaken between state laws, the Equal Pay Act and Title VII, and how to audit and analyze your pay practices.
